Legal Question in Family Law in Georgia
My daughter is looking to see an attorney regarding child custody. She is under the age of 21 and had a child with an ex boyfriend, he is not listed on the birth certificate. He has never provided for the child which is now 15 months old. We have been told to see a divorce attorney although they were never married to file abandonment thru the court. Is this correct or do we need to seek out a family law attorney?
1 Answer from Attorneys
That is completely incorrect. I don't know who would have suggested that.
First of all, she already has full and sole custody rights, unless he legitimizes the child and files a case.
So she can simply go to the state child support unit and for free, or a maximum of $25, start a child support case. She can also instead file a case with a lawyer, but that will be expensive. So you may want to simply start with the state. No attorney is needed for that.
