Legal Question in Family Law in Georgia
daughter was placed with DFACS 1 year ago, due to a report of drug use and neglect. the father and mother were given seperate case plans to complete in order to get her back.. The mother has not completed hers, but the father has completed everything and has passed all drug testing.. Court is coming up on NOV 5th and they just did urine, hair and nail test on the father for drugs and alcohol... all test came back negitive for everything WITH THE exception on the nail test came back postive for alcohol... NOW they are saying they are going to hold her for another 6 months... I dont understand how they can do this for alcohol on a finger nail test... He does not even drink anymore.. he only drinks oduls non alcoholtic beer...and drinking is not illegal anyhow, i gurantee you the people at DFACS and the judge hearing the case goes home each night and unwinds with a drink... Please help... Father doesnt know what to do...

You need to retain the services of an attorney who practices in the area of juvenile law. If you had the funds, you could have the test done and determine if other sources could be contributing to the positive test. It has been determined frequent use of Purel or other antibiotic cleansers which contain alcohol can seep into the skin. The Court is, of course, going to be concerned if alcohol turns up in a test. The Father should maintain sobriety and remain drug free and continue to follow the case plan. Get an attorney.
