Legal Question in Family Law in Georgia

My daughter is the illegitimate child of a man that just died. He has a surviving spouse and two other children by that marriage. Is my daughter entitled to anything from her biological father? How would I find out if he had a will?

Thanks,

It is irrelevant if your daughter is illegitimate regarding her rights to inherit. Did he legitimate the child before he died? Did you take him to court for child support?

In any event, start with the probate court in the county where the father lived. Also, contact the surviving spouse if you have to regarding the matter. She's going to find out anyway. Whether he has a will or not is irrelevant because she is entitled to a portion of her father's estate.

If the father lived in Columbus, you may want to contact a probate attorney in that area to discuss the matter. This should be done as soon as possible to protect your daughter's rights.
