Legal Question in Family Law in Georgia

I have a daughter by the man I'm divorcing. He is not on the Birth Certificate as we were not married at the time she was born. I'm filing for divorce and was wondering if I have to claim my daughter as part of filing as in "with children involved" or "without"?

Background, we have been seperated for 5 years, he has not seen her in 4 years, and has paid no support. We live in GA.

It sounds like you are making the horrific mistake of proceeding without a lawyer. Do NOT attempt any divorce, especially with a child, without a lawyer. It will usually be a nightmare.

When you married him, that legitimized the child. Your divorce does involve a child and before it can be completed, there must be a parenting plan to raise the child, child support, visitation, health insurance provisions for the child, a custody order and other matters.

See a lawyer immediately. This is vital both for you and your child.
