Legal Question in Family Law in Georgia

My daughter wants to move with her dad

I have legal custody of my daughter and she wants to move out of state with her dad who is a over the road truck driver. I disagree with all of this because he has never been in her life. My daughter was angry with me so I am letting her go see the grass is not always greener. I am forcing him to come off the road. What should I do legally so that he has to be responsible for her?

Re: My daughter wants to move with her dad

Many people have the misunderstanding that a child age 14 can select which parent to live with. Not so. The party seeking custody (here, the father) should file a Petition to Modification Custody, at which time the judge will listen to the child's preference but is not bound by it if is not in the best interests of the child. Consult with a local attorney.

You really cannot legally allow her father to have custody unless the divorce decree is modified. If you would like to allow such a modification, then you should start working with an attorney in order to achieve it. My family law practice serves North Georgia clients. Please feel free to call in the event that we can assist you.

This is a complicated question for which you need to sit down with a lawyer and likely draft a detailed agreement before the child goes. Call a lawyer immediately. This is a matter that we can likely assist you with.
