Legal Question in Family Law in Georgia
Daughter's legal rights as a wife.
My daughter needs to leave her husband as soon as possible before she files for divorce. He is constantly yelling and verbally abusive to her in front of the children and tries to hide the money he makes from her by putting it into accounts without her name on it. She sold her car and had to use the money to help keep their house out of foreclosure. She has ''loaned'' him over $11, 000.00 from a savings account for her son who is from a previous relationship. She recently paid the payments for his truck after the ''repo'' man drove into their driveway and started hooking up the truck with the kids in it! My grandson has even asked if he could come to our house to get away from him. She and the kids are under tremendous stress. Can she leave with the children and take one of the vehicles without incurring legal retaliation?

There are too many variables and unknown facts to give you a reliable answer in this type of forum. She could consult with an attorney to discuss the whole situation.

Her first step before doing anything should be to meet with a lawyer to determine what she should do and the consequences. The moving and filing of legal action in some cases may need to be done in close succession and no lawyer could suggest what she can and may do without a detailed consultation.
