Legal Question in Family Law in Georgia
death of ex husband
my ex husband passed away recently. I believe our daughter was left some thing in his will but his mis mom wont let me see a copy of the will, nor will she provide me a copy of his death certificate. she also has all of my daughters records, i.e. bith, immuncations. She even told the military (he was retired from the navy) that i did not exist and that she had custody of my daughter. How do I get a copy of the will and how does my daughter recive whats entitled to her. He was alsio remarried for about a year and her step mom would not let my daughter in their house and made her leave saying my daughter could not have any of her belongings cause her dad had bought them. he lived in Calif we live in georgia. My daughter is only 14, her dad and me were married for 6 years. i know shes entitled to something cause before he passed we talked about it for months before he died. it seems like his mom and wife are trying to act as if i donr exist, they were even collecting her social secruity money. when i went down to apply i had to prove she was living with me and prove i was her mother. I dont work and its been hard what can i do?

Re: death of ex husband
The GA code requires that the person holding the will present it promptly for probate. Then all the world can see it. It will be on file at the Probate Court. Consult with a local attorney, in the county of the deceased's residence at the time of his death. That is where the Will will be probated. An attorney can force her to produce the will.
