Legal Question in Family Law in Georgia

declaration of incompentency

I am searching for assistance in having my mother declared as incompetent. My purpose is to prevent her from having any influence whatsoever on myself of any of my teenage children. She is a life-long alcoholic and is prone to bouts of memory loss, verbal abuse and multiple personality characteristics. My question, in a nut shell, is how do I keep her from any contact with myself of my children. She is not capable of maintaining sobriety or even sane conversations with anyone for a span of more than 5 minutes. How do I handle eliminating her from my/their lives. There are also other family members willing to contribute information and/or facts to support my claims. (my sister, my aunt, etc.)

Re: declaration of incompentency

You should consult with a local attorney familiar with the Probate Court in your county. In all likelihood, she needs a guardian of her person (and possibly a guardian of her property as well).
