Definition of ''Fit and proper parent''

My 14 year old son has made an election for a change in custody. I have been told this is fairly cut and dried but would like to understand how the courts have dealt with this issue in the past. How have the courts defined a ''Fit and proper parent'' in their rulings? Further, have previous challenges been able turn these elections into long drawn out legal battles over which parent should have custody of the child based on the best interests of the child?

There is no real definition of what a "fit parent" is. If you or your ex wants to challenge the election of the child, it really depends on whatever judge who handles the case. You should consult with a local attorney.
