dependants and filing taxes

If my child lived with me for more than half the year-but her dad has custody-nothing in the divorce stipulates- can i claim him on my taxes legally??

This is a question for an accountant not a lawyer, but generally, the custodial parent gets the tax break if it is not specified in the divorce settlement. In this case, the custodial parent is the father and he would get the break. The child could live with you the entire year and it would not change that.
