can dfcs take my son away if i fail a drug test for marijuana? im in middle of a case from where me and my sons father was in an argument, cops were called and he went to jail. few days later i got a call from dfcs and they wanted to know what all happend and everything. well i have used marijuana recently and i know i will probably fail. my son have several health issues and he is in no way what so ever being neglected. so i just need to know if i fail the drug test can they take him from me.
ps. i have NEVER before been involved with anything legal, no records of anything never been to jail, no proir defcs cases. NOTHING!

The use of illegal drugs certainly is a reason for you risk losing custody, and it can also land you in jail. You need to immediately get legal counsel, and you should have gotten that before talking to DFCS, as you likely have already harmed your case. Stop using drugs, as a series of clean drug tests may help minimize the damage you have already done. Good luck.
