How to divide assets & debts however not marriage?

I have been living with this man for 2 years or so. We brought property & place a mobile home on the land. The deed was in his name & my sisters due the fact my husband is prison I have not divorce him yet. I thought if it was not in my name he couldn't take it from me. How we are having problems. Can he make me leave my home? I do have 2 children to think about. If he decides to sell our home will my sister have to consent also.

I'm not sure I followed your question and you didn't say which he and which we you meant, but if you are asking can your husband take the home you don't own, the answer is no. If your question is can your boyfriend kick you out, yes he can. I should meantion that while it is unlikely you'd be prosecuted, you could be prosecuted over your current living arrangements if sex is involved.

Your question is not clear. However, if I am reading it right, you are married but currently residing with your boyfriend. You have two children who, I assume, are by your marriage. If you are not on title to the home and you are not married, your boyfriend can ask you to leave. Is your sister on the actual title? If so, she would have to consent to the sell. If you have invested money in the residence, you may have the right to file a complaint in equity in order to get the money out of the residence which you have invested.
