Division of Maritial Assets

Can it be argued that my spouse can not recieve money from my retirement that accumulated during times he was unemployeed and times he did not contribute to his retirement plan?

Sure, you can argue anything. Rule is that you are both entitled to an equitable distribution of marital assets and what is equitable is up to the judge or jury based on the specific facts of your case.
