Divorce and Custody Advice
I want to divorce my husband due to verbal and emotional abuse. I want sole custody of our 17 month-old Daughter. He has threatened to kill me if I try to leave with her. He has also stated that if I do get custody that he ''has to see her some time and you'll never see her again after that''. Due to these threats, I am seeking immediate dissolution of the marriage, sole physical custody of our daughter, child support payments and for him only to have supervised visits with her since he has threatened to kidnap her.
Further pertinent information:
- I want to move to Arkansas immediately with my daughter. We currently live in Georgia. Can I move to Arkansas, then file? Will I have to come back to Georgia for any hearings or proceedings? Can I have the venue changed once I move to Arkansas if I must file in Georgia? (Important to know before I decide on a lawyer to represent me)
- If I file in Georgia, is there a general amount I can expect to pay for the entire divorce and custody proceedings? If not, how much will it cost to start the proceedings?
- What initial steps do I need to take to proceed?

Not to get support; you must file in GA, since that is his residence.

No. It will depend on how much of a fight he wants to put up.

Well, if you want to represent yourself, the only cost will be about $90.00, depending on what county you are in, for the filing fee.

I agree with the previous response. However, I am also concerned about the present safety of you and your minor child. If you are being abused physically by your spouse then you must get out that situation immediately for your own safety. Please contact local battered women shelters for some assistance. Please do so immediately.
