Legal Question in Family Law in Georgia
Divorce Laws
I have been married 17 years, with 2 children aged 17 and 11. Jan 1 wife walked out with the kids, says she is homosexual. Moved in with a female friend. Her family is very unstable. Can I move on with my life and start dating? Would that still be considered adultery since we are separeted? Don't want to give her any amuntion because I want to see about getting custody of my kids. But it is very hard to just be alone!!!

Re: Divorce Laws
It all depends whether you want sex or companionship more than your children.
Adultery is only a grounds for divorce if it causes the separation, but adultery also, even if rarely prosecuted, is a crime.
While no one here can predict a case's outcome, since your personal conduct could be an issue as to custody, why would you want to risk your children?
Re: Divorce Laws
Hopefully you have supportive family or friends at what must be a very difficult time for you. Your conduct will have implications for your ability to achieve the objectives of your divorce decree. Your best course of action at the present time is to channel your financial and mental energies into obtaining legal counsel, and work with the selected individual to obtain a divorce decree that serves the best interests of you and your children.

My advice: bite the bullet and don't date. It may come back to haunt you.
