Divorce

I came into my marriage with MY debt. My husband took it over and put it all in his name. Who is responsible for the debt?? He filed for the divorce as well.

It depends on the wording of what your husband did. You need to have the pertinent documents reviewed by an attorney.

what is marital debt is a question for the judge or jury based on the particular facts of your case. Generally, any debt brought into a marriage would be a separate debt of the party who incurred the debt and any debt incurred after the marriage would be a marital debt subject to equitable distribution. This is a legal issue, which, if you can't decide among yourselves, will have to be adjudicated and decided by the judge.
