Legal Question in Family Law in Georgia

Divorce and moving

My wife is getting a lawyer and asking for a divorce. We live in Georgia, have no kids, no house we are renting(actually free rent she manages the apartments), no joint checking or savings. Basically we have no assets together. Is it safe for me to take my belongings and move out of state and just let the divorce go unattested?

Re: Divorce and moving

Absolutely not. In fact that would not be an uncontested divorce. An uncontested case is one where both parties sign a settlement agreement at the initiation of the case dealing with assets, debts and other issues (such as alimony).

With no agreement, she is free to seek alimony and attorneys fees, and can also seek your belongings and help with paying her debt.

If you are trying to hold down costs, ask her to have her lawyer forward a proposed settlement agreement (which can lock in assets and debts and avoid alimony, etc). Spend the small cost to have a lawyer review it before you sign.
