Legal Question in Family Law in Georgia

In a divorce whereas both parents have joint custody and mom has guardianship, can mom take the child out of school to home school without the dads permission.

I have no idea what you mean by mom has guardianship. Guardianship is not awarded to a parent in a divorce. Education is a major decision which needs to be discussed and worked out between the parents if indeed you have joint custody. I suggest you look at your parenting plan to see how issues are resolved or better, have your attorney look at the paperwork and advise you.
