Legal Question in Family Law in Georgia
Divorce Question
My wife is Russian and isn't living with me.
I've threatened to divorce her if she doesn't come home to
live with me. She isn't a Citizen, but a legal alien as of right now. We've been married since October 7th, 2003.
Does she get alimony and would she have to go back to Russia if I divorce her??

Re: Divorce Question
Your focus is wrong. You can't order a spouse to live with you. If you do want a divorce, you can pursue it. It will generally backfire on you to spend time being vidictive or worrying about her immigration status. If she is concerned with that, she can confer with her counsel.
As for whether she can get alimony, nothing in your post answers that one way or the other. Her immigration status and nationality are irrelevant to that. Things like your income, her income, length of the marriage and her needs decide that question.
Re: Divorce Question
It sounds as if you have two different issues - a divorce and your wife's immigration status. Alimony will be determined by many factors - income, length of marriage, etc. - but will probably not be influenced by her immigration status.
