Legal Question in Family Law in Georgia

Divorce throw the newspaper

I have been told that I can run an ad in the local newspaper to get a divorce from my husband. I have no idea where he is or even might be. I was wondering how true this is and if you can still do it if you have childern together? He has not seen or talk to the childern in over a year.

You can have your husband served "by publication." You will have to sign an affidavit saying that you have done a diligent search for him and cannot locate him. Generally, this is a last resort. You should try to locate him if possible so that you can serve him personally and he will have a chance to respond at this time. If there are no marital property or debts, especially real estate, and you are not concerned with the amount of child support that will be awarded then you will probably be OK with filing for service by publication. Consult an attorney so you can be aware of all the issues and pitfalls that might result later from doing the divorce by publication.

Georgia does allow divorces by publication if you can show taht you did a diligent search for him.

Since you have children, doing this correctly is essential. Our office handles such matters. If you're in the Atlanta area, contact me and I'd be glad to discuss it further.
