Legal Question in Family Law in Georgia

Getting my divorce to trial

I have asked my attorney since February to get me a trial in my divorce case. He says he's sent letters to the Judge's office on 3 occassions. Here it is June and I still don't have a trial date. Has my attorney followed the process correctly? I don't see anything in my case file showing that he requested a trial. I'm thinking either he hasn't or the clerk is completely ignoring him. Which is it please? I just want to get this over with.

Re: Getting my divorce to trial

Sending letters to the Judge sounds fishy to me. Normally, I deal with the clerk's office, or, sometimes, the Judge's calendar clerk. If you have any doubts, you are always free to consult with another attorney.

You didn't say what county you are in, but in many counties, civil trial calendars are many months behind. With Governor Perdue trying to slash court budgets, these waits will get far longer, thanks to his belief that the court system is less than important to Georgians. So the biggest blame may lie with him rather than the courts.

Ask your lawyer to see copies of the letters. Assuming he has sent them, the delay is probably normal. He should be giving you copies of such letters.
