Legal Question in Family Law in Georgia
divorce worries
I am in a troubled (struggling but trying to make it) marriage, and my wife asked me to sign power of attorney to her. She just traded in a car that we both signed for, and got one in her name only. The power of attorney is so she can finish the paperwork at the dealer for the old car just traded in. Should I trust her and sign the POA, or should I be apprehensive of this? My wife works in the legal field and has many attorneys as friends. This is also her 4th marriage, and my first. Am I being set up for the kill?

Re: divorce worries
Power of attorneys should never be entered into unless there is a real need. Moreover, it is always a good idea to limit the power to the transaction at hand. For instance, if you want to give your wife the power to sign the title of the car being disposed of, describe the car and limit the effective dates of the power of attorney. Lastly, you should clearly state that the power does not authorize your wife to incur secured or unsecured debt in your name for any reason. Moreover, if you suspect your marriage is about to end, you probably need to sit down with an attorney to advise you about how to protect from any anticipated unfairness.
