i have been getting a divorce for almost 3 years and we do not live together and i have a small garage door business and i made my spouse the CEO of the company which she has nothing to do with and never has but tells everyone its hers not sure if i should quit the company and start another business doing the same thing with a new name or wait for the divorce verdict but im not sure which way it will go being she has nothing to do with the business and i do everything and always have ran it the reason she was made the CEO of my company was do to a no compete with a local company that moved me here to Georgia to run there company and i cant get an answer from my attorney about this she keeps saying it could be a marital asset if i start another company i my opinion its been long enough for it not to be a marital asset

Listen to your lawyer. If she's the CEO and you work there too, there is NO serious question that it is a marital asset. Making her CEO to avoid a no compete may possibly have been fraud, and expecting a court to help you after doing that may be unrealistic. Bucking your attorney is a great way to have a tough divorce case turn into a disaster, especially when you're likely wrong.
