divorce/bigamy

If a person gets married and the previous divorce was not final until a week later is that still considered bigamy, and is the marriage considered illegal? I know both answers are yes, so would there need to be a second divorce or would the marriage be considered NULL? Also, since the first divorce is final is this still considered a punishable offense

The divorce is valid. The person still can be prosecuted as you cannot undo a crime. The new "marriage" is void.
