Legal Question in Family Law in Georgia
Divorcing a Soldier in Afganistan
Husband is currently deployed to Afganistan. He is stationed at Fort Hood, Texas. I, the wife, reside in Albany Georgia and have for a year now. I want to do a Pro Se divorce but have been told by a few friends that since he lives in Texas, I must file for divorce there. Is this true or may I file in the state that I am in?

Re: Divorcing a Soldier in Afganistan
Forget the pro se part. Much of the time that is a disaster, and with someone in the military, it is very unlikely that you will get everything right.
Since he is in the military he can prevent you filing at at all under the Soldiers and Sailors Relief Act, so you need counsel (that act can be waived by him).
If he agrees and you reside in Georgia and have been here six months, you can file here. If he disagrees, the issue as to whether you can file in Georgia or Texas is more complex and requires information not in your post.
