Legal Question in Family Law in Georgia
dustody
I filed for a change in visitation rights because my childrens father has strong control issues. He is too demanding concerning their school work and behavior. I am unable to work with or communicate with him. When we went to court the judge was angry with both of us. He was very rude saying that I was fat and a boo hoo cry baby asking about what medications I take and if I am seeing a mental health doctor. He had heard no evidence that showed any of this, mainly only a difference in parenting styles. He is threatening to take the children away from both parents. He is a great power in a smmall county. What can I do?

Re: dustody
It appears that the judge does not take your concerns seriously or at least there is a conflict with the judge that makes it appear that he does not take your concerns seriously. It is not often that a judge will remove the children from both parents but it does occur in some cases. You should take this seriously. You should determine why the judge indicated that he was considering taking the children from both parents and address those issues.
Have you considered requesting that a guardian ad litem be appointed in your case? This is a neutral party that acts for the minor children. They will review the facts of the case and present recommendations to the judge that are supposed to be for the benefit of the minor children. Assuming that the guardian ad litem agrees with your position that the father is not acting in the best interest of the minor children this could substantially assist you with your case. Please let me know if I can be of further assistance.
Re: dustody
I doubt that the judge would terminate both parents' parental rights, but you never know. You can file an appeal from the court's decision.
