Legal Question in Family Law in Georgia
emancipation
My 18 y.o. daughter is pregnant and is currently living with her boyfriend and his parents. She is still in High School and my ex wants to discontinue child support stating that now that my daughter is no longer living with me she is emancipated. Our divorce decree states that he is to pay child support until she graduates. Should I seek out an attorney and fight this

Re: emancipation
The divorce decree controls. Consult with a local attorney. Fight it.
Re: emancipation
You are entitled to continue to receive child support. Pregnancy is not grounds for an emancipation nor is living outside of your house. There would have to be an emancipation order for your child to be emancipated. Further, you have an agreement stating that you ex-husband is to pay child support until her graduation. I would be happy to help you with your case for a low flat fee as I am beginning my own practice. Please feel free to contact me.
