Enforcing divorce decree- i.e. college education
My divorce decree orders my ex. to pay for 1/2 college expenses w/a total expense not exceeding the cost of obtaining a 4 year education at the largest state supported college/university in the state where child qualifies in-state; OR 100% of the actual expenses for child's education, whichever is less. My ex is a highly paid professional, but only paid court ordered child support becuase he had an income deduction order placed on him at work (he was contempted 3 times prior to this).He has chosen not to have any contact whatsoever with his son since he was 4.He is now 16, and looking at college. My questions: Knowing the ex's history, do I need to have an attorney contact him in the near future to let him know his child's college plans and ask how he plans to pay;if my son qualifies for HOPE but opts to go to an out-of-state, would this reduced tuition cost or the ''listed'' tuition be used when calculating 1/2 of expenses at the in-state university?;if I need to take him to court to enforce his obligation to pay, when do I do it?;if I need to get an attorney now about this, should I get 1 that specializes in family law, or what? I'm very unsure what colleges we should look at,not knowing whether dad can be made to pay his part.

You are right that you need to go ahead and consult with an attorney. The actual divorce decree needs to be reviewed. You don't need a specialist; many competent family law attorneys practice in several other areas of the law. If you are local, please free to give me a call.
