Ex-girlfriend filing for child abandonment when she's the one who keeps the baby

My fiance's ex-girlfriend refuses--name removed--let him see their daughter. She's told him that either he is a fulltime father and be with them or not see their daughter at all. She's a jealous, vindictive girlfriend who wants--name removed--just hurt my fiance for not going back with her and uses their daughter--name removed--manipulate him. He's even looked for them after she's moved and changed phone numbers. When he does find them, she refuses--name removed--let him see their daughter unless he went back with her. With all that hassle, he's learned--name removed--stay away. Now she's filing for a warrant of arrest against him for child abandonment in Georgia. How can this be and is this legal? Can't he file charges against her?

If he has a child support obligation that he has not paid in over 30 days she can file abandonment charges against him. If the child was born in the state of Georgia out of wedlock then he has no rights to the child whatsoever until he files a petition for legitimation. Until such time that he does so, she can deny him access to the child. He needs to contact a local attorney immediately to have the child legitimated if the child was born in Georgia.

In the first place you have me confused about all these "name removed" references in your posting. What's that about?

Having said that, the answer is that yes she can file charges against him. Whether they will hold up remains to be seen.

As to your second question, he may be able to file something against her but what is not clear.
