Ex-wife demanding back child support from ex-husband who lost job
My husband was required by his divorce decree to pay $710 child support. He has no college education and worked his way up to supervisor over 20 years within his company, and two years ago he lost his job. He tried several commission-only sales jobs and was out of work alot of the time. He continued paying $710 until he was unable to do so and asked a lawyer for a modification. We were unable to pay the lawyer the amount he required, so we went through the ex-wife asking her understanding until we were able to get back on our feet. My husband continued paying 17-23% of his income and now the ex-wife is going through Child Support Recovery to obtain her past-due money! We thought we had a verbal understanding. Do we need legal assistance before our hearing? Are we still required by law to pay this amount even though our income has been so greatly reduced and cannot pay bills due to his lack of employment during those two years? Do we need to file a modification now?

The agreement may not be binding since it is not an order of the court, so yes I would file a modification now. I would be glad to discuss in more detail if you wish to call.
