Legal Question in Family Law in Georgia
My ex-wife just moved herself and our 2 boy from a two bedroom apartment to her boyfriends one bedroom house. My boys sleep in the living room on the couch since there is only one bedroom in the house. She is taking my boys to a public school over an hour away everyday using the old address that we used to live in. Her boyfriend has 4 other children that come over every weekend and the six children sleep in the living room together. My ex-wife did not give me 30 days notice prior to moving like our divorce decree states that she has to.
I have since remarried and live in a nice size house with my wife and 2 stepchildren. Can I take her back to court for custody? Does the fact that my boys are sleeping in a living room and not a bedroom play an effect in my case? Does the fact that my boys spend at least 10+ hours in the car to and from school in a week help?

Of course things like that may matter, and each day you allow them to continue without going to court weakens the apparent urgency of your case. You need a lawyer, and it would be wise to see him or her tomorrow. If after hearing the details, the lawyer says to proceed, and the lawyer needs all the details AND to see the present paperwork, plan to proceed, You will likely need a few thousand dollars as a retainer, and your children are of course worth it.
