Legal Question in Family Law in Georgia

My ex-wife is taking me to court. In our divorce we were to split the house payment and I got the house. She moved in with her boyfriend--now husband. I lost my job and couldnt afford to keep the house. We agreed to do a deed in lieu of foreclosure. The mortgage company told me to go ahead and acquire another place to stay, which I did. Now my ex has made arrangments with the mortgage company and moved into the house and it taking me to court for contempt. Do I have any options besides going to jail?

The time to have asked was before you wilfully violated a court order. You might have, at a minimal cost, gotten a lawyer to negotiate a solution that would have protected you.

In acting on your own, you have a problem. You could go to jail, or be forced to pay the mortgage, or have to pay her legal fees. You will incure legal fees yourself. Make sure you hire a lawyer before 30 days elapse from service of the contempt, so you can assert whatever possible defenses he might find, or at least minimize the penalties you may face.
