Family law (custody)

My ex and i were never married we broke up around 4th month or pregnancy. he left me with credit card debt that he charged up without my knowledge. he said he would make payments throughout pregnancy. He ducked out and ignored me until 9 months. now he contacted me saying he is going to fight for joint custody. how easy will it be for him to get joint custody? im also thinking of taking him to court for the thousands of dollars he put on my credit card without my knowledge. Is that in any way relevant to the custody case? Oh and while we were together he was not supporting me. My parents had to end up supporting him.

Since you chose to have a baby without marriage, you can't sue to divide debts arising out of the relationship, under the case of Rehak v. Mathis.

There is no custody case at this point, and there is no reason for you to even think about a non-existant case. If a case is filed, then you get to address it. At present the only legal matter you have is the one you didn't ask about. You can file for child support.

You should consider a legitimation proceeding to establish court-ordered custody, visitation, child support, etc. Consult with a local attorney.
