I am a single mother, my son turned one march 8th, we have our on home i work hard to support him alone, his father has not seen him sence he was a monthe old and has never supported him, your typical dead beat dad.out of no where he called me the other day and said he was coming to get my son. he has a very unstable life style! can he take him from me? we were never married but he did come up and sign the birth certificate. i am very worried. what should i do?

Your first step is to see a lawyer.

He doesn't have any automatic rights to custody or visitation, although he could seek those in court and it would then be up to the court. At this point the decision as to visitation is solely yours.

If he has gone 30 days without support, you can go to your local court and swear out a criminal abandonment warrant for his arrest if you haven't already done so. Once there is a warrant, if he shows up at your home and has not yet been arrested, dial 911 and report that there is a wanted person at your door.

The abandonment case may help you get child support resolved.
