My sister was murdered by her husband and then killed himself; leaving their 10 year old daughter without either parent. My niece now lives with her paternal grandmother (73 years old) and my husband and I are trying to get custody of her. In the meantime who has rights to the child?

This needs to be addressed by the appropriate officials, and you should have a lawyer immediately. The question will be the bests interests of the child, and not necessarily who has "rights to the child." Either way, counseling should be part of the plan now, and going forward.

Until a court rules on it, no one does. You need a lawyer immediately. The court will act in the best interest of the child and may make a decision other than the one the family may expect.
