why does a father have to legitimize his parental rights if he has had sole custody of his children for more than 10 years?

If a father has NOT legitimized a child, under Georgia law he has NO custody rights and the legal custodian under the facts you posted is the mother. The reason he has to do it is that he failed for ten years to see a lawyer and do what Georgia law required him to do to seek custody.
