if the father & I were never married, can I still get him for desertion/abandonment?

Abandonment is only grounds for a fault-based divorce in the case of marriage. Since you are not married, there can be no "abandonment" or desertion.

If he is not supporting your child, he can be sued for child support or prosecuted for abandonment. He cannot abandon you since you chose an illegal relationship rather than marriage.
