Legal Question in Family Law in Georgia

The father of my 14yr old niece gained custody of her after her mother died in 2006. She would like to live with her grandmother who also lives in Walton County, GA.

I've heard there was a law where a 14yr old could determine who they wanted to live with. What actions do we need to take to move forward with this?

Yes. At age 14 the child can decide. See O.C.G.A. � 19-9-3(5). The child's grandmother should file a petition for modification of child custody. It will be much easier for her if she gets a lawyer. However, if money is an issue, check with the Walton County Court to see if they have a petition for modification of child custody form that you can use. If not, either borrow one from a neighboring county or draft your own. Again, I recommend that you use a lawyer as he or she can do this.
