Ok here it goes. My wife divorced me in 2001 I had it put in the divorce that there was to be no mereticious relationships. She moved her fiance in a month before they got married and she concevied there child out of wedlock. She was about 5 months pregnant. I am always keeping my child on her mothers day, taking her to the doctor, and showing up for all school functions. I have her registered in my school distirct per our divorce. She has now moved and can move her to another school. Know i have been out of work and owe some back child support but that will be paid in full in a few weeks. What i need to know is since i live with my mother and she is now married can she take my custody away from me? I have joint custody she is the custodial parent. I am just curious with her now being remarried can she take my daughter away from me. We are supposed to discuss all changes but she just went and changed my daughter to her new husbands insurance. I have my daughter every other weekend fri, sat, and sunday nightand every tuesday night and Wednesday night.

The issues presented by your question go well beyond the scope of anything I can answer here for you today--except to say that you need to pay any back child support you might owe as soon as possible. Your ex-wife may ask the court to modify the custody decree based on a change in circumstance. It is her right to ask; however, it is ultimately up to the court to decide custody.

You should consult with a local attorney ASAP because there are some things, like catching up the back child support. Beyond that, there is more to discuss than can be included here.
