Legal Question in Family Law in Georgia

where do I file for divorce?

I want to get a divorce from my husband whom I haven't seen in over 4 years. I recently found out that he is incarcerated at Montgomery State Prison. I think that he lived in Bibb County before being locked up, but I haven't talked to him in so long I'm not sure where he was/is living. I know that was where we both lived at the time we were married. I currently live in Walton County. We got married in Gatlinburg, TN.

Can I file for divorce here in Walton County? Do I have to file where we were married? He left me 4 days after we were married (yes, I was dumb and stupid...but that's another story) so there are no joint assets or anything like that.

Also, can I get forms anywhere on the internet for free (I'm VERY financially strapped) or can I get them from a county clerk or someone?

Thanks!

Re: where do I file for divorce?

Since there are no assets for a judge to split, you can file a divorce by publication in the county of your residence. Clerks usually don't have forms for divorce, since each case is different. I don't know where you might get forms. Consult with a local attorney. Maybe you can get a reduced rate for just helping you with the paperwork.
