I am filing for divorce how can I get my name removed from the lease to the apartment that m husband and I shared? he has moved someone else in and my children and I had to move out.

First of all, do NOT file for divorce, especially one with children, without a lawyer. That will go VERY badly. It is essential to get a lawyer.

Second, you CANNOT get your name off a lease unless the landlord agrees to that. If the landlord does not agree, you will remain liable to the landlord.

I am not sure why you had to move out. If you were on the lease you had the legal right to remain at the residence. In any event, you can meet with the landlord and explain to him/her that you no longer reside at the residence and provide the circumstances. The landlord may agree to remove you from the lease but is under no obligation to do so. If the landlord does not agree, there is nothing you can do. If your husband moved someone else in, he should have listed that person as an occupant with the landlord. You really need to speak to an attorney prior to filing for divorce. People who try it on their own are often dissatisfied with the final result because the didn't know what they were doing.
