Financial Responsibility

In a divorce proceeding, may I be held jointly responsible for debts my spouse incurred in a prior marriage and brought to the marriage? This especially relates to debts on which her and her ex still hold jointly in name only. Also, are their any circumstanes known where a judgment of divorce would not be given, in the event she fights the proceedings?

You cannot be held responsible for debts of your spouse prior to the marriage. These are seaparate property. You could not be granted a divorce if you continue to cohabitate after the filing of the divorce
