Legal Question in Family Law in Georgia

Get full custody from a verbally abusive father in GA

Alright, I'm doing research to see if it would be possible for my girlfriend's mother to get full custody of her from her verbally abusive drunk divorced father. This is in the state of Georgia.

I'm not 100% sure on all the details here so please bare with me. The mother and father are divorced, she (16) and her little brother (9) live with mom. As far as I know her father has i guess joint custody of them being that by law he is entitled to visitation rights. Also from what I've heard he would have to ''sign them over'' to waive these rights. Is that joint custody?

He is verbally abusive to my girlfriend telling her how worthless she is and how much he hates her, all the time, and that's when he's NOT drunk. I'm afraid of the long term emotional effects it will have on her, because I can already see some of them surfacing. While not physically abusive, from what I've read this is still considered a form of abuse is it not?

I beleive he is supposed to pay child support but doesn't.

I know to be sure there is a case an attorney would need alot more detailed info but from what I've described does it seem like there is a way to get this deadbeat off her back?

I appreciate any advice I can get. Thank you for your time!

You need to talk to a Georgia attorney, because the laws may be different in Alabama.

As you stated, I would need more detail to give you a better, more complete answer, but you would need to petition the court and ask that his visitation be limited or eliminated and also ask for back child support. In a nutshell, it is up to the courts.
