Legal Question in Family Law in Georgia
need GA code for appeal
I was a resident of GA, where my child was born in 1999. We moved to California 2001. After a paternity test in 01, father signed paternity acknowledgment. In 2003, father married and filed for custody.
CA Court says that I did not have de jure or de facto custody because there was no custody order prior to 2003.
I am looking for GA code that says that a mother has sole physical custody at birth, if there is no presumed father which would give me ''de jure custody'' before the 2003 hearing.
Anyone know where that is?
Thanks,

ps. this info will be used for my appeal brief due in two weeks.

19-7-25. In whom parental power over child born out of wedlock lies
Only the mother of a child born out of wedlock is entitled to his custody, unless the father legitimates him as provided in Code Section 19-7-22. Otherwise, the mother may exercise all parental power over the child.
