Legal Question in Family Law in Georgia
US / German divorce with debts
My German husband and I married in Georgia, lived in Germany for 13 years. Never lived in the U.S. together. 11 months ago, I, a US citizen, moved to GA with our 5 yr old, with the tacit and grudging consent of my husband. He had been unable to work or parent our child for 2 years due to substance abuse and mental illness. Our son is now integrated into school, church, circle of friends, and of course, family, here in GA. I have many more possibilities to support myself and our son here. In Germany, my husband is doing better now, earning money and expressing great interest in coparenting. I want a divorce, with as extensive as is healthily possible shared parenting. But I want to live in the US with our son. I would simply file for divorce here in GA but for one thing: we have about $200,000 debt from personal liabilty for his business debt, which we theoretically share 50-50. I do not trust him in financial matters and want him to commit to repay debts to my family (a tax write-off for him!) in lieu of a certain amount of child support. I don't know if this is a wise course of action. This is an unappetizing mixture of family law and accounting! Any insight on where/how to file would be greatly appreciated.

Georgia does not divide things 50-50. Georgia uses equitable distribution.
