What is best for our little girl?

Mom is legal custodial parent in a joint custody case (6 yrs. ago), she remarries and divorces husband 2. At the trial we are handed a dvd of child abuse of the child by the mother. Boyfriend #2 after the divorce, hits the child & she has lived with us since(7 months). When do we make are move to do whats best for our little girl? She see's her mother about 2x a month, her mother has a new boyfriend, no job, no home for the child, no means of transportation, etc. We have established a new home, new school, new friends... Now mom wants her back to live with her & the new boyfriend @ his parents house. HELP! She has threatened that she has the rights by paper, but when do we step in to do whats best for this very confused 8 yr. old?
