Legal Question in Family Law in Georgia

Grandparents rights

Does a grandparent have visitation rights to see a grandchild if the parent refuses to let them, for good reason of course, or if the child refuses to want to see the grandparent. And if the grandparent does have the right, can the parent refuse to put that child on a particular type of transportation if the grandparent lives in another state? The child is three.

Re: Grandparents rights

In NY, grandparents have a limited right to bring a visitation action in court but only in certain situations. Such as if one parent is deceased or they have had a substantial and meaningful relationship with the child or when the parents have interfered with that relationship and the grandparent shows a true effort to have tried to establish the relationship despite the interference.

If one of those situations fits, then the court must then decide whether it is in the child's best interest to have the grandparent visit. That's where you would tell the Judge the reasons you refused the visitation.

Also, a 3 yr old does not travel out of state to visit, the grandparent comes to the child.

If you permit the out of state visit the mode of transportation is your decision as the parent.

Re: Grandparents rights

Grandparents have limited rights for visitation in certain circumstances. It is not automatic and must be requested through a family court with local jursdiction. Under no circumstances would a parent be required to travel with or transport a 3 year old out of state to visit grandparents.
