Legal Question in Family Law in Georgia

grandparents rights

I currently have legal custody of my grandson. The case is subject to be reviewed when my daughter and her husband finalize a divorce. In the event that my daughter is granted custody I know that I will be able to continue to be a part of my grandsons life. If my son-in-law gets custody I know that he will attempt to exclude me from my grandsons life. I have been the one stable part of his life since his birth. This has been recognized by the Dept of Family and Childrens services and the court of law. If my soninlaw does get custody what would I need to do to establish grandparents rights. I know that these have to be issued by a court of law and are not automatic. Under what circumstance can I petition to establish these rights?

If your son-in-law gets custody, then you probably will want to have a family law attorney prepare your petition for you in an effort to assure that your case if fully presented.
