Legal Question in Family Law in Georgia
Grounds for Divorce in Georgia
In a situation where:
The wife has left her husband, due to financial difficulties which led to eviction, and she decided to go her separate way, this having happened in May 2002 - and she has no desire to resolve things with her husband, and is not interested in getting back with her husband - does he, according to GA state law, have to wait until they have been apart for at least 1 year before the divorce can be finalized? I believe the husband has already ''filed'', back in May, based on the grounds of abandonment. At this point, if he doesn't want to wait a year, is it possible for him to change the grounds status from abandonment, to irreconcilble differents, or a ''no fault'' divorce?

Yes, irreconciliable differences would be the ground for divorce in this situation.

Yes, he can change the grounds for divorce. As to the one year, I know of no such state law that mandates that; however, different judicial circuits have different minimum times which must elapse before the divorce can be finalized. Check with a local attorney.
