Legal Question in Family Law in Georgia

guardianship/custody

If the Mother of a child wants me to have custody in the event of her death, and her husband signed the birth certificate but is not the biological father, what are my legal rights and what are his legal rights? And what do we need to do to make her decision legaly binding? I am not a blood relative.
